That's correct. On theme 9 the footer is a repeating pattern image.

Are we able to change colors yet? Or is this only going to be available on new themes?

For now it's only available on new sites (as of a month or so ago). We're still tweaking and improving it and then we're going to figure out a way to minimize the time to upgrade the sites from those that wish to do so.
